1. PARTIES
1.1 SELLER: The individual or entity offering art pieces for sale through the www.opentheart.com platform, as detailed below.
1.2 BUYER: The individual purchasing a product from the www.opentheart.com website, whose information is collected via the system.

2. SUBJECT OF THE AGREEMENT
This agreement regulates the sale of the product(s) ordered by the BUYER from the SELLER via the www.opentheart.com website.

4. DELIVERY

5. RIGHT OF WITHDRAWAL

  • To exercise the right of withdrawal, the BUYER must notify the SELLER via email or through the site’s communication channels within this period.

The right of withdrawal cannot be exercised in the following cases:

  • Products prepared according to the BUYER’s personal preferences or specific needs (e.g., personalized drawings, custom artwork).

  • Products that are quickly perishable or have an expiration date.

6. RETURN CONDITIONS

  • The product must be returned to the SELLER within 10 days following the withdrawal notification.

  • The product should be returned in its original packaging, with the invoice and in complete condition.

  • The return will be processed within 14 days after the product is received by the SELLER.

7. GENERAL PROVISIONS

  • The BUYER acknowledges that they have been informed of the essential characteristics, price, and delivery time of the product available on www.opentheart.com.

  • This agreement becomes valid once the BUYER electronically approves the terms and conditions.

8. JURISDICTION
In case of any disputes arising from this agreement, the court with jurisdiction will be determined based on the monetary limits set by the Ministry of Commerce, and the BUYER may choose the competent court in their jurisdiction.
